20 Okt. Verbal Job Offer in Germany: When Can You Resign?
A verbal job offer in Germany is a serious signal. However, it is not yet proof that the role is yours.
The useful question is not “Do they like me?” It is: what has actually been decided, what remains open, and when will the commitment be visible in writing?
Many international professionals treat the words “we would like to make you an offer” as the end of the hiring process. In practice, however, they often mark the beginning of another stage: internal approvals, salary sign-off, contract drafting and administrative steps.
That does not mean the employer is playing games. Usually, the process is still moving. But it does mean you should not reorganise your life around a sentence that has not yet become a document.
Is a Verbal Job Offer Binding in Germany?
Online advice often gives you two extremes.
One says: “A verbal offer is binding. Resign now.” The other claims: “Verbal offers mean nothing. Keep applying until you start.”
Both are too simple.
A casual “we would like to offer you the job” is usually an expression of intent. It may depend on budget approval, salary sign-off or other internal steps. By contrast, a clear written offer, with agreed terms and a confirmed start date, is a much stronger signal.
The practical question is not whether the offer is verbal or written. It is which stage you are actually in.
This is general orientation, not legal advice. If a lot depends on the decision, such as resignation from a secure job, relocation or a visa-related timeline, have the actual documents checked by a qualified professional.
The Four Stages of a Job Offer in Germany
A German hiring process does not usually move directly from “we like you” to your first working day. Instead, there is a sequence in between.
1. Verbal interest
The hiring manager says the company would like to offer you the role.
This is encouraging. However, approval, budget or salary sign-off may still be open. At this stage, the offer is not a basis for resignation. German Hiring Process: Who Really Reads Your Application?
2. Approved offer
Internal approval is largely complete. Consequently, the employer can discuss terms and expects to send a contract.
Details may still move. Additionally, the written contract may not yet exist.
3. Written contract
The role, salary, start date and main conditions are documented.
Your signature alone, however, does not yet show that the employer is bound. Read the document carefully before signing.
4. Counter-signed contract
Both sides have signed. As a result, the commitment is visible and provable.
This is still not absolute certainty. Therefore, check the probation period, notice arrangements and whether termination before the start date is excluded.
The counter-signed contract is the practical point at which a job offer becomes a commitment you can plan around.
This is not a legal taxonomy. It is a practical map. Its purpose is to help you see what has been decided and what has not.
A Short Example
An experienced engineer receives a call after the final interview.
The hiring manager says: “We would like to offer you the position.”
Rather than resigning immediately, the candidate asks: “Is the offer already approved internally, including salary?”
The answer is no. Salary sign-off and the written contract are still pending. So the candidate asks for a realistic timeline, keeps one other process active, and waits for the counter-signed contract before resigning.
The contract arrives later than expected. Nevertheless, the role is secure.
Nothing dramatic happened. Yet one direct question turned an uncertain verbal signal into a usable decision.
What Can Still Change After a Verbal Offer
Even after a positive conversation, several details can still change.
Salary and budget
Salary and budget approval are the most common points of movement. For example, the offer may come in lower than hinted, or approval may take longer than expected.
Start date
The start date can also move. This is especially likely if your notice period is long or the role is not yet fully cleared.
Role details
The role itself can shift during contract drafting. In particular, the title, grade, team or scope may be adjusted if the position was recently redefined.
Internal approvals and works-council steps
More rarely, a budget or headcount freeze can delay an offer. In some cases, it can even stop it.
A works-council step can also add time. In routine cases, though, it is a process step rather than a sign that the employer has changed its mind.
Therefore, do not read every delay as rejection. Instead, read it as incomplete information.
What to Ask After a Verbal Offer
You do not need to interrogate the employer. Instead, you need to establish the stage.
Ask directly:
- “Is the offer already approved internally, including salary?”
- “What is still open before I receive the written contract?”
- “When can I expect the contract, and when would it be counter-signed?”
- “Is the start date already confirmed?”
For public-sector or graded roles, add:
- „Ist die Eingruppierung bereits geklärt?“
These questions are not pushy. They are professional. Moreover, a serious employer will not be offended by them.
When to Resign After a Job Offer in Germany
The rule is simple:
Do not resign on the strength of a verbal offer. Resign when you hold the contract signed by both sides.
The reason is asymmetric risk.
If you resign too early and the offer fails, you may be left without a job. By contrast, if you wait for the counter-signature, the usual cost is a slightly shorter runway.
A written offer is better than a verbal one. However, check the wording. A phrase such as „vorbehaltlich Freigabe“ means the offer is still conditional.
There is a narrow exception. Some candidates resign on a clear written offer with a confirmed start date, especially when their notice period is long. That can be a conscious risk decision. Still, it should not be the default.
Also remember: resignation itself needs written form with a handwritten signature. An email, however, is not enough.
What a Serious Employer Communicates
This is not only a candidate-side issue.
If an employer says “we want you”, it should also say what that means. Specifically, a serious employer tells you:
- What is firm.
- What remains open.
- When they expect the next update.
- When the written contract will arrive.
- Whether any approval, budget, grading or works-council step is still pending.
An honest version sounds like this:
“We would like to offer you the position. Final approval is still open and we expect clarity by [date]. Please do not make any commitments on the basis of this message. We will send the written contract once approved.”
Even “we cannot confirm anything yet” is acceptable, provided it comes with a date for the next update.
Vague enthusiasm followed by silence is not a candidate-management problem. Rather, it is weak process management.
What to Do If the Contract Is Delayed
If the promised contract does not arrive, send one factual follow-up. How to Follow Up on a Job Application in Germany, Without Damaging Your Chances
Then ask what is still pending, when to expect the contract, and when the counter-signed copy is likely to arrive.
“You mentioned the contract would be sent by [date]. Could you let me know what is still pending and when I can expect the counter-signed copy?”
In German:
„Sie hatten erwähnt, dass der Vertrag bis zum [Datum] verschickt wird. Könnten Sie mir bitte mitteilen, was noch aussteht und wann ich mit der gegenzeichneten Version rechnen kann?“
Until the contract is counter-signed, keep other options active. That is not disloyalty. Instead, it is risk management.
The Honest Limits
This approach does not turn a verbal offer into a secured job.
Nor does it replace reading the actual German employment contract or obtaining legal advice for a high-stakes decision.
Furthermore, it cannot force an employer to send a contract, confirm a start date, or avoid internal delays.
What it can do, however, is help you stop confusing interest with commitment.
A positive conversation is a signal. A counter-signed contract is a commitment. Plan accordingly.
